The House of Representatives has filed a complaint before the Department of Justice against Ronnie Dayan, the former driver-bodyguard of Sen. Leila de Lima, for his failure to appear before its inquiry despite a subpoena.
The complaint against Dayan, for his disobedience to the House's summons, was filed by Rep. Rey Umali, House justice committee chair, on Thursday morning.
The affidavit submitted before the DOJ was signed by Umali, along with House Speaker Pantaleon Alvarez and Majority Floor Leader Rodolfo Fariñas.
It said Dayan violated Article 150 of the Revised Penal Code, which lays down the penalty for a person who "refuses, without legal excuse" to obey summons to attend as witness before a legislative body.
Dayan, who was arrested in November, said De Lima—with whom he had a seven-year affair—had advised him against attending the House hearing on the proliferation of drugs inside the New Bilibid Prison (NBP).
In his signed affidavit, Dayan said he sought De Lima's advice after receiving the subpoena. The senator, former DOJ secretary, was contacted by his daughter, Hannah.
